In using this website and by engaging Bloomfield in business and services, you agree and acknowledge that Bloomfield shall be given an unlimited, irrevocable, world-wide, and continuous license to use, publish, recreate, and sublicense any information you have provided us for any purpose. The Type of Information Bloomfield Collects About You

Bloomfield may collect the following categories of information from and about you, including but not limited to: (1) Direct identifiers such as name, alias, social media identifier(s), IP address, username and password, postal and/or email address, account name and/or account number, social security number, driver’s license number, passport number, and/or state identification number; (2) Related identifiers such as date of birth, bank, credit, or debit card number, financial information, insurance policy number, and/or license plate information; (3) Physical characteristics, including protected characteristics under federal and state law such as age, sex, race, and ethnicity; (4) Commercial information, including records of Products and Services purchased, obtained, or considered, and other histories and tendencies; (5) Biometric information; (6) Internet or other electronic network activity information; (7) Audio, electronic and visual information, including telephone recordings, electronic communication records, and security camera footage; (8) Employment related information, such as work history, salary/income history, and education history.

 

How Bloomfield Collects Information About You

Bloomfield collects your information in three ways: (1) directly from you; (2) automatically; and (3) from third parties. 

Information collected directly from you includes but is not limited to: information you provide by completing forms, either in person or electronically; information you provide while accessing Bloomfield Products and Services; records and copies of correspondence between you and Bloomfield; details of transactions you carry out through Bloomfield’s Products and Services; and search queries on Bloomfield’s website.

Information collected automatically from you when you interact with Bloomfield’s website or when you communicate with Bloomfield includes but is not limited to: details of your activity on Bloomfield’s website, including cookie information (identification information transferred to your browser or device that permits recognition of your browser or device and provides information regarding visitation of website pages and features), traffic data, location data, and logs and other communication data; information about your electronic device and internet connection, including your IP address, operating system, and browser type; and Email interactivity information such as opening, navigating, and click-through information.

Information collected from third parties includes but is not limited to: data analytics providers for the purpose of receiving statistical data about your activity on Bloomfield’s website; social media networks for the purpose of collecting information such as profile information, screen names, contact information, contact lists, and information regarding your contacts through the social media platforms; third party service providers, including but not limited to internet service providers; and public sources such as local, state and federal government agencies and departments. If you click on a link to a third-party website or service, a third party may also transmit cookies to you and/or collect information about you. You understand and acknowledge this Policy does not cover the use of cookies and/or information by any third parties.

By submitting your information, you are agreeing to receive emails and marketing materials at the frequency we deem necessary. If you do not consent or agree to this Privacy Policy, please do not access or use any of our Sources or communicate with us (as a basis for processing your Personal Information is your consent to this Privacy Policy). If you wish to withdraw your consent, please follow the procedures set forth in our Opt-Out Policy to withdraw your consent (in whole in or part) by following our opt-out procedures.

As this website is not directed toward children, we do not knowingly collect information from children. Children should not use this website without parent supervision.

Our Opt-Out Policy

Email Marketing: To stop receiving newsletters or marketing communications from us or to opt out of having information, such as your email address shared with third parties, please use the “unsubscribe” mechanism provided in the communication or send an e-mail to internetsales@bloomfieldhomes.net along with the information necessary for us to process your request. 

Text/SMS Messaging: To stop receiving communication via text/SMS messaging, respond “STOP” to any text communications received from Bloomfield Homes or send an e-mail to internetsales@bloomfieldhomes.net requesting to be removed from text/SMS communications.

When ordering or registering on our site, as appropriate, you may be asked to enter your: name, e-mail address, mailing address, or phone number. You may, however, visit our site anonymously.

Disclosing and/or Sharing Personal Information

 

Bloomfield may disclose your Personal Information to third parties for business purposes. Bloomfield does not sell your Personal Information to third parties for money. In the preceding twelve (12) months, Bloomfield has disclosed or shared Personal Information as follows:

 

        Identifiers, Personal Information, Protected Classification Characteristics Under California or Federal Law, Commercial Information, Internet or Other Similar Network Activity, Geolocation Data, Professional or Employment-Related Information, and Inferences Drawn from Other Personal Information are disclosed with service providers for the purpose of providing Bloomfield’s services and enhancing online experiences. Such disclosures are made pursuant to contracts that describe the purposes, require the recipient to keep the Personal Information confidential, and prohibit using the disclosed information for any purpose except performing the contract.

        Bloomfield does allow marketing providers to use Identifiers, Personal Information, Internet or Other Similar Network Activity, Geolocation Data, and Inferences Drawn from Other Personal Information for the purposes of optimizing online experiences and customizing advertising. Such disclosures may constitute the sale or sharing of Personal Information under the CCPA and/or California law.

 

You retain the right to opt out of Bloomfield’s tracking technologies for analytics and advertising service providers by emailing our Internet Sales Department at internetsales@bloomfieldhomes.net




Your Individual Rights and Choices

 

The CCPA provides California residents and consumers with rights regarding their Personal Information.

 

                Right to Know

 

You have the right to request that Bloomfield disclose certain information to you regarding the Personal Information it collects, uses, and discloses and/or shares. Once Bloomfield receives such a request and confirms your identity, it will disclose to you:

 

        The categories of Personal Information collected, sold, or shared;

        The categories of sources for the Personal Information collected;

        The categories of third parties to whom the information is disclosed or with whom the information is shared;

        Bloomfield’s business or commercial purpose for collecting or disclosing that Personal Information;

        The specific pieces of Personal Information collected about you; and

        The categories of Personal Information disclosed for a business purpose.

 

The foregoing information will be provided to you free of charge (no more than twice in a 12 month period) unless Bloomfield determines, in its sole discretion, that your request is excessive or unreasonable.

 

                Right of Deletion

 

You have the right to request that Bloomfield delete any of your Personal Information it has collected and retained, subject to certain exceptions. Once Bloomfield receives such a request and confirms your identity, it will determine if an exception allowing Bloomfield to retain the information applies. Bloomfield may deny your deletion request if retaining the information is necessary for it or its services providers to, among other things:

 

        Complete the transaction for which Bloomfield collected the Personal Information, provide a good or service that you requested, fulfill the terms of a written warranty or product recall, or otherwise perform Bloomfield’s contract with you;

        Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;

        Debug products to identify and repair errors that impair existing intended functionality;

        Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;

        Comply with the California Electronic Communications Privacy Act;

        Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research achievement, if you previously provided informed consent;

        Comply with a legal obligation; and/or

        Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

 

Right to Not Disclose/Transfer

 

You have the right to tell Bloomfield not to disclose or transfer your Personal Information to a third party in in exchange for something of value.

Such requests can only made by you or someone legally authorized to act on your behalf. Before Bloomfield will provide specific pieces of Personal Information to an authorized agent, you must verify your identity directly with Bloomfield and/or confirm directly with Bloomfield that you have given the agent permission to submit the request for specific pieces of information. Alternatively, an authorized agent may make a verifiable consumer request based upon a power of attorney pursuant to California Probate Code sections 4000 – 4465. Bloomfield reserves the right to deny a request from you and/or an authorized agent if all requirements are not satisfied. Making a verifiable consumer request does not require you to create an account with us.

 

You may only submit a request to know twice within a twelve (12) month period. Bloomfield cannot respond to your request or provide you with Personal Information if it cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Your request to must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information (or an authorized representative), which may include:
  • Email and password (for customers with password protected accounts)
  • For non-account holders who make requests to know categories of personal information or for deletion, personal information data points that match at least two data points maintained by us
  • For non-account holders who make requests for specific pieces of personal information, personal information data points that match at least three data points maintained by us, together with a signed declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

 

Bloomfield cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

 

You do not need to create an account with us to submit a request. We will only use personal information provided in the request to verify the requestor’s identity or authority to make the request.

 

                Non-Discrimination

 

Bloomfield will not discriminate against you for exercising your CCPA rights. Unless permitted by the CCPA, Bloomfield, in response to you exercising your CCPA rights, will not: deny you goods or services; charge you different prices or rates for goods or services; provide you a different level of quality of goods or services; or suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services. Please note, however, that certain financial incentives permitted by the CCPA may result in different prices, rates, or quality levels.

 

Changes to this California Notice

 

Bloomfield reserves the right to amend this California Notice at any time. Your continued use of Bloomfield’s website constitutes your acceptance of the California Notice and any amendments and/or modifications thereto.
